Order pronounced.
The respondent is directed to pay the amount of assured return
at the agreed rate as per clause 3 of the allotment letter dated 04.05.2016
i.e. at Rs. 116.66/-sq. ft. per month on super area of the unit till
completion of construction of the said Building. The amount of assured return
already paid i.e. Rs. 41,48,124/- by the respondent to the complainant may be adjusted
while paying the residual assured return. Other reliefs
will form part of the main order.

The Complaint received on 08.02.2023
and reply received on 18.10.2023.
The complainant is seeking payment of assured
return with directions for handing over of possession and delayed possession charges in terms of
the allotment letter dated 4.5.2016.
The counsel for the respondent states that
the assured return was paid upto November,2018
and total amunt of Rs. 41,48,124/- has been paid to the complainant as
assured return. However, due the
enactment of the BUDS Act, in the year 2019, the respondent was unable to
pay any more assured returns. Further,
the Authority does not have jurisdiction to adjudicate upon issue relating to
the BUDS Act and assured return . The
matter has been raised before the Hon’ble
High Court of Punjab and Haryana in CWP No.26740 of 2022 and is
pending.
Counsel for the complainant states that the
matter has been made cleared by the Hon’ble High Court vide their orders dated
22.11.2023 that the respective authorities are at liberty to continue
proceedings in this regard.
