During personal hearing, Sh. Vishnu
Shokeen is present on behalf of the promoter. The promoter has submitted the
affidavit declaring that he will submit the approved service estimates and
plan, fire scheme approval, mining permission within 3 months. The promoter has
obtained the in principal approval of building plan from DTCP, Haryana vide
memo no. ZP-1085-JE(SK)-2019/7057 dated
08.03.2019. Therefore, the authority has decided to grant registration
certificate on the basis of provisional building plan and direct the promoter
to submit the final approval of building plan within 3 months along with other
pending approvals from the date of grant of registration certificate. No sale
shall be effected without approval of final building plan as per condition 4(F)
imposed by the DTCP, Haryana in the in principal approved building plan. |

Since no one appeared on behalf of the promoter for the online hearing. 3 opportunities of hearing were given to the promoter, but he was not able to submit the mandatory documents as conveyed to him vide email dated 06.06.2020 and notice dated 28.01.2020, 29.02.2020. Hence, the authority has decided to issue show cause for the rejection of real estate project namely Hightown being developed by Silverglades Infrastructure Pvt Ltd following the due procedure as provided under section-5 of the Real Estate (Regulation and Development) Act 2016 and Rule-5 of the Haryana Real Estate (Regulation and Development) Rules, 2017. |

Deficiencies were pointed out vide notice no. HARERA/GGM/RPIN/2311 dated 28.01.2020. Accordingly, reply was submitted by the promoter on 06.02.2020 which was scrutinized and found that still there are major deficiencies which needs to be rectified by the promoter which are as follows: 1. Copy of approved service estimates and plans not submitted. 2. Copy of fire-fighting scheme approval not submitted 3. Copy of approved building plan not submitted. 4. Non encumbrance certificate not submitted 5. Renewal of license no. 110 of 2013 not submitted. 6. Online corrections not done by the promoter. 7. Copy of mutation, jamabandi and aks-shijra certified on the recent date needs to be provided. 8. Mining permission needs to be submitted. 9. approvals of storm water drainage and sewerage applied but not submitted 10. Deficit fee cannot be calculated as approve building plan not submitted till date. Fees will be calculated after submission of approved building plan. 11. Information to revenue department about the fact that project land licensed and bonded for setting up of a colony not informed to the revenue department for entry in the record of ownership. 12. Copy of super imposed demarcation plan on the approved layout plan showing khasra numbers not submitted. 13. Allotment letter, application form, conveyance deed and payment receipt in the prescribed format needs to be submitted. 14. Revised builder buyer agreement as per prescribed format not submitted 15. Brochure of HIGHTOWN needs to be submitted. Hence, the promoter is given 15 days’ time the submit the deficit documents. Accordingly, the matter is fixed for hearing on 16.03.2020 |
