Subject: Project hearing regarding the registration of Affordable Group Housing namely
“The
Skyline “measuring
10.00 acres situated at Village Babupur, Sector-106, Gurugram developed by M/s MRG Castle Realty LLP. Ms. Anjana Gulati is present on behalf of
the promoter. The promoter M/s MRG castle Reality LLP. applied for registration
certificate of real estate project namely “The
Skyline-106” for the area admeasuring 10.0 Acres located in Village
Babupur, Sector-106, Gurugram under section 4 of the Real Estate (Regulation
and Development) Act, 2016 vide Online
application ID- RERA-GRG-PROJ-873-2021 dated 12.06.2021 and
RPIN-340. The Temp I.D. of
REP-I (Part A-H) is - RERA-GRG-PROJ-873-2021, the application by the
promoter was scrutinized and deficiency notice indicating major and minor
deficiencies was conveyed vide notice no. HARERA/GGM/RPIN/340 dated
15.06.2021. The Department of Town and Country Planning, Haryana has granted
the license to develop an affordable group housing under Affordable Group
Housing Policy of 2013 and amendments from time to time for the area
admeasuring 10.00 acres vide license no. 43 of 2020 dated 28.12.2020 to K.N.
Infracon Pvt. Ltd.
The Promoter
has obtained the approval of the change of developer and transfer of license
to M/s MRG castle Reality LLP vide Memo No.LC-4306/Asstt. (MS)/2021/6744,
dated 14.07.2021 from DTCP, Haryana.
The reply
submitted by the Promoter dated 14.07.2021 which was scrutinized and found
that all the deficiencies are fulfilled by the promoter except approved environmental clearance,
approval of fire scheme and approved service plans and estimates. However,
application is already applied for these approvals in the concerned department
but final approval is still awaited.
Therefore, the
promoter is directed to submit the copy of approved environmental clearance,
approved fire scheme and approved service plans and estimates within three months from the date
of grant of registration certificate.
The Authority has decided to grant registration for the
project with the following conditions mentioned above and directed the
promoter to comply within three months from issuance of the registration
certificate.
The promoter is advised to submit detailed project
information duly binded and also fill up online DPI information at
hrera.in/app1/sign_up within 7 days.

the change of developer and transfer of the license to M/s MRG castle Reality LLP
vide Memo No.LC-4306/Asstt.(MS)/2021/10224, dated 20.04.2021 (Final approval
pending.)
The
reply submitted by the Promoter dated-28.06.2021.
Some of the major deficiencies in the project are-
1. Legal
capacity of the applicant needs to be clarified. License
is in the name of K.N. Infracon Pvt. Ltd. (Promoter has in-principle approval
of the change of developer and transfer of the license to M/s MRG castle Reality LLP.
(Final approval pending.)
2. Environmental
Clearance is not provided by the promoter.
3. Approval
of the Fire Scheme is not provided by the promoter.
4. Approved
Service Plans and Estimates.
Keeping in view of the facts
stated above it is not advisable to issue a registration certificate for want of
requisite approvals. The AR of the company Ms. Anjana Gulati submits that
company has received in-principal approval of DTCP for change of developer and
transfer of license and final approval of same as well as approval of EC and
fire scheme are expected shortly. In view of the same, the AR seeks adjournment for
their submission. Meanwhile, the AR is advised to complete the online DPI in all
respect along with requisite attachments.
Accordingly, the case is adjourned to
20.07.2021.
