The promoter “M/s Landmark Apartments
Pvt. Ltd.”. applied for a registration certificate of real estate
project namely “Landmark the homes-81” for the area admeasuring 5.0 Acres
located in Sector- 81, Gurugram., under section 4 of the Real Estate
(Regulation and Development) Act, 2016 vide Online application
ID- RERA-GRG-PROJ-844-2021 dated 07.04.2021 and RPIN-322. The Temp
I.D. of REP-I (Part A-H) is - RERA-GRG-PROJ-844-2021, the
application by the promoter was scrutinized and deficiency notice indicating
major and minor deficiencies was conveyed vide notice
no. HARERA/GGM/RPIN/322 dated 15.04.2021 to remove the above deficiencies/
observations and given an opportunity of hearing on 26.04.2021 given to
the promoter. During the first hearing dated 26.04.2021, promoter was directed
to apply in the name of M/s S.R.V Automotive Private
Limited who is also a license
holder.
The Department of Town and Country
Planning, Haryana has granted the license to develop an affordable group
housing under the Affordable group housing policy of 2013 for the area
admeasuring 10.25 Acres vide license no. 04 of 2021 dated
02.03.2021. to M/s S.R.V Automotives Private Limited. On the
1st hearing dated 26.04.2021 The the authority has decided to
issue a show-cause notice to the promoter under section 5(b) and
Rule-5 of the Real Estate (Regulation and Development) Act 2016 as to why the
application for the reasons as mentioned above shall not be rejected as such
application does not conform to the provisions of the Act or the rules or the
regulations. The reply of the show cause notice was submitted by the promoter
on 07.06.2021 and clarified the legal capacity of the Project.
Deficiencies of the Project which are still
pending after the submission of the reply dated 15.04.2021, 23.04.2021,07.06.2021(Legal
Capacity Clarified),15.06.2021,28.06. 2021 are Environmental Clearance, Fire
scheme approval and Service plans and estimates approval. However, the
promoter requested to allow two months’ time for their submission as the same
already in advance stage of approval with the concerned department including
environment clearance applied on 23.03.2021, fire scheme approval applied on
03.06.2021 and service plans and estimates applied on 07.06.2021. The
undertaking for the same need to be submitted by the promoter.
Therefore, considering the above view the authority
has decided to grant registration for the project with the following
conditions mentioned above and directed the promoter to comply within two months
from issuance of the registration certificate.
The promoter is advised to submit detailed project information duly
binded and fill up online DPI information at hrera.in/app1/sign_up within 7
days.

Approvals/ NOC’s from various agencies for connecting external services like roads, sewage disposal, stormwater drainage needs to be submitted.Reply submitted on-15.04.2021, 23.04.2021,07.06.2021(Legal Capacity Clarified),15.06.2021,28.06.2021.Meanwhile, the AR is advised to complete the online DPI in all respect along with requisite attachments. Proceedings Dated: 26.04.2021Ms. Bhanu Chhabra, Planning Executive briefed about the facts of this case.Sh. Rajesh Grewal, Manager Operations is present on behalf of the promoter. The application for registration of project has been made by M/s Landmark Apartments Pvt.Ltd. who is neither the license holder nor the collaborator in the license issued by the DTCP Haryana. Either the applicant has to get its name included as collaborator in the license from the DTCP or should obtain BIP permission or change of developer. As such Landmark has got no legal authority to apply for registration of project. Large number of other deficiencies have also been communicated by the authority vide its communication dated 15.04.2021, such as approved building plans, environmental clearance, service plan estimates etc. A show cause notice be issued to the promoter under section 5(b) of the Act as why the application for the reasons as mentioned in the deficiency notice dated 15.04.2021 shall not be rejected as such application does not conform to the provisions of the Act or the rules or the regulations.
