15-Jun-2021 Project Brief Proceedings dated: 15.06.2021Sh. Gajender Bhatti, Associate Planning executive briefed the facts about the project.Dr. Yash Pal Yadav and Sh. Sant Sharan are present on behalf of the promoter. The Application for registration of the DDJAY project namely “3B Homes Pataudi One” situated in village – Janaula, sector – 1, Pataudi, Gurgaon being developed by M/s Sunsat Educational Academy Pvt Ltd. (License Holder) was received  in the authority under section 4 of the Real Estate (Regulation and Development) Act, 2016 on 08.03.2021. The application was scrutinized and some deficiencies were found which were conveyed to the promoter vide notice no. HARERA/GGM/RPIN/310 dated 12.03.2021 with the opportunity of hearing on 22.03.2021.  Sh. Sant Sharan, (Authorized Representative) Sh. Rahul Dagar (Legal Representative) was present on behalf of the promoter and requested for some time to submit the deficit documents and the next hearing was fixed for 05.04.2021. The promoter has submitted the reply for deficiency notice on dated 03.04.2021, after the scrutiny of the reply, it was found that the promoter has not complied with all deficiencies mentioned in notice. On the date of hearing i.e. 05.04.2021 no one was present on behalf of the promotor and the  authority directed to issue a show cause notice to the promoter under section 5(1) as why the application for grant of registration should not be rejected on account of deficiencies and in lieu of the same a show cause notice vide notice no - HARERA/GGM/RPIN/310 /Showcause1 was issued to the promoter dated 22.04.2021, and next date of hearing was fixed for 24.05.2021. However, the hearing was adjourned due to covid 19 pandemic. The promotor had submitted the reply to the show cause notice on 26.05.2021 and the same was scrutinized and it has come to the notice of the authority that the order vide memo no. LC-3990/JE(SJ)/2021/11001 date 03.05.2021 issued by DTCP, Haryana for part surrender of license area admeasuring 0.087 acres and revised schedule of land measuring 10.813 acres is issued and in lieu of the same the promoter has to submit revised layout plan, superimposed demarcation plan with khasra nos., zoning plan and revised service plans and estimates, however the promoter has submitted another reply dated 14.06.2021 and the same has also been scrutinized, and the deficiencies are still pending which needs to be rectified.1. The AR of the promoter made a statement that within one week online corrections in REP-I (Part A to H) will be done. As the DPI online portal is under development within 15 days, necessary information as per corrected DPI shall be uploaded.2. Hard copy of the DPI after incorporation of corrections as suggested shall be submitted within a week. 3. Copy of service plans and  estimates submitted. As the lay out plan of the project is under revision with the DTCP and in principal permission is available accordingly service plans shall be approved by the competent authority based on revised approved lay out. 4. The promoter shall submit a scheme of sewage disposal , storm water drainage, and water supply as same are not available from HSVP.  As per the conditions of the license same are to be arranged by the promoter till its provisioning by HSVP or any other local authority.5. Non encumbrance certificate is signed by the sub registrar whereas it should have been signed by the Revenue officer i.e. Tehsildar or Naib Tehsildar. 6. As per policy only 50% of salable area is to be frozen by the DTCP  and accordingly 97 plots comprising 50% area has been frozen.  7. The AR confirms that there are no sales till now.8. The AR confirms that revenue department has been informed about the project land being licensed and bonded for setting up of a colony. 9. Financial resources to be incorporated in the DPI. 10. There are no other costs.11. Bank undertaking in original is to be submitted. Although the copy submitted meets the requirements of the contents. 12. Necessary affidavit shall be affixed with the DPI. 13. Missing details of project component may be placed in the final DPI. 14. Undertaking regarding BBA, allotment, application form, payment receipt and conveyance deed shall be as per the format prescribed by the Authority shall be used. 15. Compliance regarding super imposed demarcation plan on approved lay out plan submitted. 16. Although PERT chart submitted but completion period shown is too long keeping in view the size of the project. 17. Brochure will be submitted with the final DPI.18. MOA object clause already amended. 19. Documents at Sr. No. 19 of the deficiency sheet will be annexed with the final DPI. The promoter submitted the reply dated 26.05.2021 and 14.06.2021. It has come to the notice of the authority that the order vide memo no. LC- 3990/JE(SJ)/2021/11001 dated 03.05.2021 issued by DTCP, Haryana for part surrender of license area admeasuring 0.087 acres and revised schedule of land measuring 10.813 acres was issued, however, the promoter has applied for the approval of service plans and estimates for the land area admeasuring 10.52 acres which will be corrected by the promoter/competent authority as per the revised approved lay out plan. After considering facts and circumstances of the case the Authority decided to register the project.The registration certification will be issued after submission of the final DPI and other compliances as above.  Dr. K.K. The promoter was advised to amend the memorandum of association so that real estate activities covered under the object clause. Deficiencies as mentioned in the project hearing brief have already been conveyed to the promoter. Reply to the notice was submitted today morning itself. LC IV B be submitted along with DPI. There are glaring mistakes in the DPI which need to be corrected. As on now there are large number of deficiencies. Major deficiencies being such as approved service plans and estimates, approved lay out plan, approved zoning plan, non encumbrance certificate, project report, bank undertaking. Show cause notice be issued to the promoter under section 5(1) as why the application for grant of registration should not be rejected on account of deficiencies as this application does not conform to the  provisions of the Act, Rules and regulations made thereunder.
