Sunsat Educational Academy Private Limited (‘The Promoter’), which is the absolute and lawful owner of land measuring 10.90 acres falling within the revenue estate of Village Janaula, Sector-1 Pataudi, Distt. Gurugram (‘Said Land’), has been granted approval/ sanction to develop and set up an affordable plotted colony (‘Project’) under Deen Dayal Jan Awas Yojna-2016 in the Said Land by The Town and Country Planning Department, Haryana.
The Promoter has prepared and submitted to the Haryana Real Estate Regulatory Authority a draft agreement for sale (‘Agreement’) which it intends to enter with proposed allottee(s) (‘Allottee(s)’) . The Agreement is as per Annexure A of the HRERA Rules, 2017 (‘Rules’) and gist of the important provisions of the Agreement are as follows:
1. Total Price:
1.1. Total price (subject to other terms and conditions of the Agreement) for transfer of the residential plot, as specified in the Agreement, is inclusive of EDC, IDC, GST and Cess or any other taxes/ fees/ charges/ levies, IFMS, etc. leviable as on date.
1.2. The Allottee is obligated to make payment as per the payment plan annexed to the Agreement.
2. Default in Payment:
2.1. If the Allottee(s) delays payment(s) as are due and payable in accordance with the Agreement, the Allottee shall be liable to pay interest at the rate prescribed in the Rule 15 of Rules.
2.2. In the event the Allottee(s) continue to default in payment beyond 90 (ninety) days, the Promoter shall be entitled to cancel the allotment in its discretion.
3. Cancellation of Allotment:
3.1. The Allottee(s) reserves the right to cancel/ withdraw his/ her allotment in the Project as provided in the Real Estate (Regulation and Development) ACT, 2016 (‘Act’).
3.2. In the event the Allottee(s) proposes to cancel/ withdraw from the Project without any fault of the Promoter, the Promoter is entitled to forfeit the booking amount/earnest money paid for the allotment and interest component on delayed payments, if any.
4. Possession
4.1. The possession of the residential plot shall be offered to the Allottee(s) on or before the possession date specified in the Agreement.
4.2. The foregoing obligation is subject to Force Majeure (as defined in the Act), Court orders, Government policy/ guidelines, decisions affecting the regular development of the project.
4.3. The Promoter, upon obtaining the occupation certificate or part thereof, shall offer physical possession of the residential plot to the Allottee(s) within 3(three) months from the date of receipt of such approval.
SPECIFICATION OF CONSTRUCTION
Specification of apartments and other buildings including the following:
CERTIFICATE FROM A CHARTERED ACCOUNTANT CERTIFYING THAT THE INFORMSTION PROVIDED BY THE APPLICANT IN FORM REP-1-C-X IS CORRECT AS PER THE BOOKS OF ACCOUNTS/ BALANCE SHEET OF THE APPLICANT
