26-Aug-2020 | During online hearing, Mr. Jagdish Nanigeni along with his team is present on behalf of the promoter. During discussions few points were raised which are as follows: 1. Deficiency fee of Rs. 11,82,261 needs to be submitted by the promoter. 2. It has been brought on record that a loan of Rs. 200 crores have been taken by the builder by mortgaging the land. Encumbrance is created in favour of Standard Chartered Bank. Hence, the promoter is directed to submit the affidavit that the land shall be made free from all encumbrances and master account and RERA account will be loan free and lien free and all the repayments will be done from free account. 3. The promoter is directed that the builder should declare reasonable completion period of the project i.e. not beyond the validity of license. Matter to come up on 07.09.2020. | ADJOURNMENT | --- |

17-Aug-2020 | The case came up for hearing today. During discussions three main points were raised: 1. Deficiency fee to the tune of Rs. 11,82,261. It has been directed that the matter with regard to deficiency may be sorted out urgently failing the promoter shall be liable for making full payment in the matter. 2. It has been brought on record that a loan of Rs. 200 crores has been taken by the builder by mortgaging the land. Encumbrance is created in favour of Standard Chartered Bank. As a matter of principle the land should be free from all incumbrances only then he shall be able to issue conveyance deed in favour of the apartment buyers as per the provisions of section 11(h) of the Real Estate (Regulation and Development) Act, 2016. 3. There is also dissipation with regard to the completion of the project. Since the license has been issued in 2008 and the proposed completion date has been given 2029. The project shall be completed in 21 years which seems to be unreasonable. In this way interests of home buyers are fully jeopardized. It is therefore, directed that the builder should declare reasonable completion period of the project. Although promoter may indicate different dates for different towers for giving possession to the allottees after taking Occupation Certificate from competent authority.
