This commercial high-rise project is a part of Vatika India Next (VIN) Township spread over sectors 81-85 Gurugram which is being developed over an area of 489.71 acres which comprises of residential plotted colony, group housing, commercial and amenities.   This application for registration is part of the residential plotted colony which has been licensed vide 3 nos. licenses issued in favor of various landowners. Ltd.     Total 13.18       Application for grant of registration of town square 2 After the scrutiny of the application, deficiencies were noticed, which were conveyed to the promoter vide notice no. HARERA/GGM/RPIN/174 dated 30.08.2019 with directions to remove the deficiencies failing which their application may be rejected following the due procedure as provided under section-5 of the Real Estate (Regulation and development) Act 2016 and Rule-5 of the Haryana Real Estate (Regulation and Development) Rules, 2017. Also, an opportunity of hearing was given on 18.09.2019. In reference to the notice dated 18.09.2019, the promoter has submitted various replies in response to various deficiency notices and those replies were accordingly scrutinized by the authority and matter was heard in the authority. Total 19 opportunities of hearing were offered to the promoter regarding removal of deficiencies in the application for registration of real estate project. In the last hearing dated 27.07.2021, the matter was discussed at length. Online DPI was checked and found that still there were corrections which needs to be done by the promoter. These corrections were conveyed to the promoter in the hearing. The promoter was also directed to submit the corrected copy of Part (A-H) and detailed project information along with sold and unsold inventory. The matter decided to come up on 10.08.2021. The promoter has submitted the reply on 09.08.2021 which was scrutinized and found that the promoter has submitted the corrected DPI along with corrected online Part (A-H) and list of sold and unsold inventory. The promoter has already made certain sales without registration accordingly separate penal proceedings shall be initiated for violation of section 3 read with section 59(1) and the promoter undertakes to comply with the orders of Authority in this regard. Regarding approvals for sewage disposal, storm water drainage from competent authority  it was  submitted that this commercial development over an area of only 1.6 acres which is part of plotted colony of 489 acres which is already connected to the master services of HSVP and the instant commercial project is to be internally linked with the system of the colony and hence no approval of HSVP is required.   The documents which are still pending are as follows: 1.  Copy of renewal of license no. 113 of 2008 and 71 of 2010. Application for renewal has been attached. EDC and IDC are fully paid. schedule of EDC and IDC attached. 2.  Copy of renewal of environment clearance stands expired on 03.09.2020. Application applied for renewal on 18.09.2017. (Copy attached)   The AR submits that renewal approval of license and environmental clearance shall be submitted within a period of two months.  Keeping in view that the EDC/IDC dues have been fully paid in respect of three licenses where this commercial project is situated. (As per the ledger copy of EDC of DTCP downloaded online).   BBA format has to be strictly as per the Haryana Real Estate (Regulation and Development) Rules, 2017. In case any variation is required then with full justification separate application be made to the Authority. The Authority decided to grant registration subject to submission of renewed environmental clearance and renewed license within a period of two months.  APPROVED AND READY FOR CERTIFICATE ISSUING PROCESS ---
