about the facts of the project.
Sh.
C.M. Batra (Sr. G.M. Legal), Sh. Nitin Kohli (Legal), Sh. Ajay Bawa (Sr. GM
Architect), Ms. Shilpa Malik (Regional Head), Sh. Sanjeev (Finance), are
present on behalf of the promoter.
Sh.
Ashish Drall (AR of GLS Infratech Pvt. Ltd.) and Ms. Urvashi Wadhwan (AR of Commander
Realtors Pvt. Ltd. and Yule
Propbuild Pvt. Ltd.) landowners are present.
The
Authorized Representative of the promoter states that the current application
dated 19.02.2026 has been applied for registration of phase 1 comprising an
area admeasuring 4.96 acres falls under license no. 57 of 2025 dated 17.04.2025
which is granted by DTCP in favour of G.P. Realtors Pvt. Ltd., Mews Conbuild
Pvt. Ltd., Fiverivers Developers Pvt. Ltd., Fiverivers Township Pvt. Ltd.,
Panoply Propbuild Pvt. Ltd., Commander Realtors Pvt. Ltd. and Yule Propbuild
Pvt. Ltd. in collaboration with M/s
Sobha Limited for Residential Colony (under NILP Policy-2022) over an area
measuring 11.9968 acres (after migration of entire area from license no. 212 of
2023 dated 19.10.2023).
The
license no 212 of 2023 dated 19.10.2023 was granted by DTCP in favour of G.P.
Realtors Pvt. Ltd and others in collaboration with Commander Realtors Pvt. Ltd.
for development of Affordable Residential Colony under DDJAY – 2016 over an
area measuring 13.0844 acres (an area measuring 3.8625 acres migration from
license no. 21 of 2013 along with fresh applied area) which stands reduced to
12.059 acres after surrender of part area measuring 1.025 acres out of 13.0844
acres.
Also,
the license no. 21 of 2013 dated 17.05.2013 was granted by DTCP in favour of
Yule Propbuilt Pvt. Ltd. in collaboration with Commander Realtors Pvt. Ltd. for
commercial colony over an area measuring 3.8625 acres in sector 63, Gurugram.
Meanwhile,
the permission of change of developer from Commander Realtors Pvt. Ltd. to GLS
Infratech Pvt. Ltd. was granted vide DTCP, office endst. No.
LC-4852/JE(SB)/2023/36999 dated 31.10.2023. Further, the permission of Change
in Developer from GLS Infratech Pvt. Ltd. to Sobha Limited was again granted by
DTCP, vide office endst. No. LC-5265/JE(RK)/2025/11615 dated 31.03.2025.
Thereafter, license no. 57 of 2025 dated 17.04.2025 valid up to 16.04.2030 was
granted by DTCP to G.P. Realtors Pvt. Ltd., and others in collaboration with
Sobha Ltd. for developing the Residential Colony (under NILP Policy-2022) over
an area measuring 11.9968 acres.
The
Authorized Representative of the promoter states that no third-party rights of
any manner/kind have been created by the present as well as the erstwhile
promoters and collaborators/developers of the license no. 212 of 2023 dated
19.10.2023 and 21 of 2013 dated 17.05.2013. The AR of the promoter further
states that they have submitted an affidavit from a Managing Director of M/s
Commander Realtors Pvt. Ltd. and M/s GLS Infratech Pvt. Ltd. (Change of
Developer from 31.10.2023 to 31.03.2025) regarding no sale, no marketing and no
building plans were ever applied along with the affirmation and declaration
that the company has not created any sale or third-party rights and neither
advertised said land with respect to license no. 212 of 2023 dated 19.10.2023
and 21 of 2013 dated 17.05.2013.
The
Authority has taken note of the submissions made by the Authorized
Representative of the promoter regarding the non-creation of third-party rights
of any kind by the erstwhile landowners and collaborators with respect to
license no. 212 of 2023 dated 19.10.2023 and 21 of 2013 dated 17.05.2013. It is
directed that, the promoter shall submit all the remaining joint affidavits of
(landowners and collaborators) in respect of license no 212 of 2023 dated
19.10.2023 and 21 of 2013 dated 17.05.2013 along with other remaining
deficiencies mentioned at S. No. 32.
Keeping
in view of the above, it is decided that a public notice (for 10 days) be
published in three prominent newspapers (two English and one Hindi) having wide
circulation with respect to the claim of the promoter regarding non creation of
third-party rights of any kind/manner by present as well as erstwhile landowners
and collaborators of the license no. 212 of 2023 dated 19.10.2023 and 21 of
2013 dated 17.05.2013.
