briefed about the facts of the case.

(AR), Sh. Manik Sharma (AR) and Sh. Bharat Vigmal (AR) are present on behalf of
the promoter and states that DTCP vide order bearing memo no
CCD-123/2024/24921-24 dated 06.08.2024 with directions to keep approval of S+4
floors in residential plots on hold in view of deliberations held in CM No
11909 of 2024 in CWP No. 9115 of 2021. Therefore, in view of the same, he
wishes to proceed with the registration of S + 3 floors only as already
applied. The promoter has applied for registration of 279 floors on 93
residential plots along with 3 commercial blocks.
Further, regarding
fire scheme approval of commercial plot no. 6 and 8, the AR of the promoter
stated that, this is a small commercial component area admeasuring 1022.715
sqmtr and 431.823 sqmtr each having height less than 15 sqmtr for each and they
will submit the approval within 2 months.
The promoter has
already submitted the written consent of 1321 allottees out of 1955 existing allottees which is 67.57% i.e., more
than 2/3rd of total number of allottees for changes in respect
of revisions in approved layout plan of 52.2750 acres registered vide RC no 68
of 2021 and the public notice was also published in two prominent newspapers
i.e., The Tribune and Dainik Tribune dated 17.07.2024 for inviting objections
with respect to the revisions in layout plan against which no objections had
been received in the Authority. For the commercial component measuring
1454.535 sq mtr only (Commercial plot 6 and 8) and
having height less than 15 meters, fire NoC is applied and is to be granted by
the local fire officer which shall be submitted within 2 months and condition
to this effect will be incorporated in the RC.
So, keeping in view of the above peculiar facts, approved as
proposed subject to rectification in form A-H and DPI. |
