promoter.
During the last hearing, the promoter was asked to
submit BGs of Rs. 25 lakh each for submission of pending approval of service
plan and estimates as well as approval of fire plans. The Associate
Architectural Executive confirms that the requisite BGs have been submitted to
the Authority as per the above details. Further, the promoter was required to submit
pending QPRs and annual audit reports in respect of the existing registered
projects. The promoter submits that up-to-date QPRs of the existing project as
well annual audit reports have been uploaded on the website as well hard copies
submitted in the registry of Authority and a certificate of the concerned branch in charge has also been placed
in the office file. The Associate Architectural Executive confirms that no
other compliance is pending, and the case fulfills the requirement for the
registration of the project, and accordingly the Authority decides to grant the registration. |

be submitted as a guarantee to obtain service estimates and plan approval
within three months otherwise bank guarantee shall be encashed/forfeited. A
certificate from the concerned branch regarding submission of the annual audit
report of project accounts in respect of projects registered till 31.03.2021
and QPRs of the projects of the promoter till last quarter is to be
submitted.

Sh.Rajiv Srivastava (GM) is present on behalf of the promoter.Corrections in online DPI have been made by the promoter and the hard copy of the same is yet to be submitted. On request of the promoter, the hearing date for the registration of the project is preponed from 30.05.2022 to 23.05.2022. The promoter has made the application for the approval of the fire scheme and service plans and estimates in the concerned departments and the final approvals are still awaited. The promoter has also submitted an undertaking from the bank regarding not affecting the rights and interest of allottees as per section 11(4)(h) of Act, 2016 vide dak ID 32335 dated 10.05.2022.The promoter is directed to submit a bank guarantee of Rs 25 lakhs on account of the approved fire scheme and Rs. 25 lakhs on account of approved service plans and estimates in the Authority within one week from the date of grant of registration. The same shall be forfeited by the Authority, in case, the requisite documents are not submitted to the Authority within the stipulated time. The promoter has been directed to submit the status of submission of QPRs and compliance of Section 4(2)(l)(D) in respect of other registrations of the promoter and its associate companies within three days and the office to submit confirmed status on next date.Matter to come up for compliance on 30.05.2022. |

Ms. Neeraj Gautam, Associate Architectural Executive briefed the facts
of the case.
Sh.Rajiv Srivastava (GM) is present on behalf of the promoter. Corrections
in Online DPI have been made by the promoter and the hard copy of the same is
yet to be submitted. Corrections in Part C of REP-I are still pending.
It is noted that exclusive charge by way of equitable mortgage on
project land (undivided share) and building (Developer’s share) has been
created and the sold and unsold receivables corresponding to the upcoming
project have been hypothecated.
Further, the collaboration agreement registered
between the landowner and the developer is revocable. As per clause 32.1.c of the
above agreement, “In the event after the allotment of flats in the Affordable Housing
Project, the DEVELOPER doesn’t commence work on the said land for a period of 6
months or abandons the works, this agreement may be terminated at the sole
option of the OWNER by issuing a written notice to DEVELOPER and on
termination, the non-refundable amount of Rs. 5 crores paid by the DEVELOPER
to OWNER shall stand forfeited. Any works done on the said land shall vest with
the OWNER and the OWNER may take over the project and get the project
completed, or the said land cleared, at the sole risk and cost of the
DEVELOPER.” Keeping in view the above observations, the Authority decides that a show-cause notice be issued for rejection of
the application for grant of registration under section 5 of the Act of 2016
and read with rule 5 of Haryana Rules, 2017. If the promoter has to say in this
regard, an opportunity of hearing is given to the promoter on 30.05.2022. |
