Ms. Prachi Singh, Planning Executive briefed
about the facts of the project. Sh. Anish Dham (AVP) is present on behalf of
the promoter. The AR is submitting the DD of Rs. 1,31,600/- towards the deficit
fees. The corrections in form A to H and online DPI have been made as two
separate DPI for registration of plots as well as individual floors have been
submitted with a combined form A to H. The requisite approvals of building
plans have been submitted along with approved service plan and estimates for
the colony for which additional license measuring 1.625 acres for plotted
development in contiguity to the existing license colony of DLF Phase-IV has
been approved by DTCP and copies also submitted. In view of the above, the
Authority decides to grant registration for sale of 60 floors over 15 number of
plots under the said project. |

An application regarding
registration of residential floors projects namely “Independent Floors at DLF
City Phase IV” situated at sector-27, Gurugram, Haryana being developed by M/s DLF Ltd. was submitted on 18.01.2022
under section 4 of Real Estate (Regulation and Development), Act 2016.
This application falls
under residential plotted colony project admeasuring an area of 248.18925 acres
in which the license vide no. 208 of 2008 dated 29.12.2008 valid up to
24.12.2025 has been issued by DTCP in favor of M/s DLF Ltd. for the development
of group housing admeasuring area of 1.625 acres.
The layout
plan dated 04.2008 was issued by DTCP, Haryana.
Further, the
land parcel was never developed as Group Housing and no third-party rights were
created over the same.
In accordance
with the internal development plans, application for layout plan revision was
submitted to DTCP, Haryana on 09.07.2021 which stated that request for
utilizing this licensed land for carving out residential plots instead of
development of group housing.
Subsequently,
DTCP accorded an in-principal approval on the revised layout on 14.10.2021 with
which public notice was carried out in accordance with the statutory
requirements & final approval was accorded on 10.01.2022.
The application submitted by the
promoter for the said project contains 15 residential plots on which total of
60 units are to be constructed. On scrutiny of the application, some of the
major deficiencies/observations were observed which were conveyed to the
promoter vide notice no. HARERA/GGM/RPIN/424 dated 07.02.2022. The promoter has
submitted the reply dated 17.02.2022 which was scrutinized and still the
following deficiencies remains: -
1. The annexures
in the online are not uploaded as well as the correction needs to be done in
the online (A-H).
2. Corrections in Detailed Project Information needs to
be done.
3.
Copy of
approved service plans and estimates along with the sanction letter from DTCP,
Haryana needs to be submitted.
Further, it has come to the
notice of the authority that the part CC/CC for the applied licensed area is
not obtained by the promoter. Therefore, individual plots are also required to
be registered before registering the independent floors. Since the promoter is
not selling the individual plots and undertakes to develop and sell only
individual floors and hence detailed information in respect of both plots and
floors to be taken and to come together for registration on 14.03.2022. |
