The
promoter has applied earlier for registration of the residential floors project
namely “Orchid Ivy Floors” dated 12.11.2021 comprising of 79 residential plots
situated at M-Block, Mayfield Gardens, Sector-51, Gurugram, Haryana. Further,
the promoter has submitted the request of withdrawn of the application of
registration of project in the hearing held on 20.12.2021 mentioning the reason
for the same and which was allowed by the authority.
The promoter later resubmitted the fresh
application for registration of 19 plots instead of 79 plots on 04.03.2022 under
Section 4 of the Real Estate (Regulation and Development) Act, 2016.
On
scrutiny of the application, few of the deficiencies and observations were
observed primarily w.r.t. the legal capacity of the applicant which were
conveyed to the promoter vide notice no. HARERA/GGM/RPIN/403/show cause dated
08.04.2022.
The promoter submitted
the reply dated 26.04.2022,19.05.2022 and 07.06.2022 along with a court decree.
The ambiguity w.r.t. the legal title still persisted. Therefore, during the
hearing dated 27.06.2022, the authority referred the matter including court
decree for legal clarification to Mr. Ankur Mittal (AAG).
The
legal opinion sought from Addl. AG Haryana has been received dated 25.07.2022
and taken on record and it has been advised by the AAG to consider registration
of the project in the interest of allottees and also clarified that legal title
ofthe applicant stands duly proved by way of decree passed by the competent
court. During the hearing dated
27.07.2022, the Authority decides to grant in principle the registration of the
project subject to rectification of the errors/deficiencies conveyed in the
above office note and to come up on 01.08.2022 for confirmation and compliance.
In compliance of the directions of the authority, the reply submitted by the
promoter on the same day of hearing, which was scrutinized, and all the
deficiencies are removed by the promoter.
Keeping in view, the above facts the authority may
grant the registration certificate to the promoter. |
