The Promoter has submitted an application in the
authority vide central receipt no. 14915/30771 dated 07.04.2022 to prepone the
hearing date keeping in view of the sacred and sacrosanct time of Chaitra
Navratri. Sh. Saurabh Mishra (Manager) is present on behalf of the promoter.
Ms. Neeraj Gautam, Associate Architectural Executive briefed the facts of the
case. The Promoter has made the requisite changes in online DPI and REP-I (Part
A-H) and the hard copies of the same shall be submitted in the authority within
one week. The AR of the promoter undertakes that the applications for approval
of environmental clearance, service plans and estimates and fire scheme have
been made in the concerned departments and the approvals of the same are still
awaited. The AR states that the equitable mortgage has only been created
and the RERA account with 70% of the collections is absolutely charge/lien free
and shall only be used for the project and lender of the promoter namely CSL
Finance Limited further undertakes vide letter dated 07.04.2022 that as per
section 11(4)(h) of the Real Estate (Regulation
and Development), 2016, after the execution of registered agreement by
the borrower in favour of any allottees for sale of any apartment, plot or
building, as the case may be, on which charge/mortgage has been created by the
borrower in favour of lenders, then such apartment, plot or building, as the
case may be will not be part of mortgage or charge subject to receipt of entire
sale consideration from buyer/allottees for such apartment, plot or building,
as the case may be in RERA Escrow Accounts.
The authority decides to grant registration to the
promoter subject to the submission of bank guarantee of Rs. 10 lakhs on account
of approved fire scheme and submission of bank guarantee of Rs. 10 lakhs on
account of approved service estimates and plans or security cheque of Rs. 25
lakhs on account of submission of approved fire scheme and approved service
estimates and plan within one week from the date of grant of registration and
submission of approved environmental clearance, fire scheme and service
estimate plans and estimates within three months from the date of grant of
registration. This bank guarantee shall be forfeited in case of failure to
submit the approved fire scheme and approved service plans and estimates within
three months from the date of grant of registration. |

Sh. Sorabh Mishra (AR) is present on the behalf of
the promoter. However, the applicant promoter is yet to get the change in name of
developer and developer of license as well from Sterling Infrastructure LLP and
KJS Colonizers LLP to M/s Top Haven Developers Pvt. Ltd. from DTCP although the
applicant has submitted the compliance of all the conditions of in-principle
approval granted by DTCP on 01.02.2022. Further, the approval of building plan,
fire NOC, EC and service plan estimates, etc. is also not yet obtained and the
AR of the promoter seeks 3 weeks’ time for their submission.
