Proceedings dated: 20.12.2021Ms. Prachi Singh Planning Executive briefed the facts of the case. Sh. Anish Dham (AVP) and Sh. Siddharth Gandhi (GM) are present on behalf of the promoter. An application regarding registration of residential floors projects namely “Independent Floors at DLF City Phase I, II and III” situated at DLF City Phase-I, II and III, Gurugram, Haryana being developed by M/s DLF Residential Developers Limited was submitted on 24.11.2021 under section4 of Real Estate (Regulation and Development), Act 2016.Details of the 11 residential Plots: -1. Plot No. H-7/1 falling under licenses no. 08 of 1982 dated 27.04.1982, 02 of 1982 dated27.04.1982 and 125 of 1998 dated 16.10.1998 was issued in favor of M/s Bhagirathi Investment Pvt. Ltd., DLF Housing and construction Ltd. and DLF Universal Ltd. Further, of M/s Bhagirathi Investment Pvt. Ltd. and DLF Housing and construction Ltd. which got merged into M/s DLF Home Developers Ltd. vide order dated 06.11.2000 and 08.07.2010. M/s DLF Universal Ltd. changed to M/s DLF Limited vide certificate of incorporation issued by Ministry of Corporate Affairs on 27.05.2006.2. This Plot No. N-6/14 conveyed to M/s Universal Limited vide sale deed no. 7266 and 7267dated 14.03.1986 and 25.01.1986. Further, M/s DLF Universal Ltd. changed to M/s DLF Limited vide certificate of incorporation issued by Ministry of Corporate Affairs on27.05.2006.3. This Plot No. N-4/17 conveyed to M/s Universal Limited vide sale deed no. 7266 and 7267dated 14.03.1986 and 25.01.1986 from M/s Paragon Real Estate Apartments Pvt. Ltd. and M/s Instant Batteries Ltd. Further, M/s DLF Universal Ltd. changed to M/s DLF Limited vide certificate of incorporation issued by Ministry of Corporate Affairs on 27.05.2006.4. This Plot No. S-12/14 conveyed to M/s Universal Limited from M/s DLF Ltd. vide sale deed no. 7268 dated 28.01.1986. Further, M/s DLF Universal Ltd. changed to M/s DLF Limited vide certificate of incorporation issued by Ministry of Corporate Affairs on 27.05.2006.5. This Plot No. S-17A/3 falls in license no. 55 of 1992 dated 19.06.1992 was issued to M/s DLF Universal Limited. Further, M/s DLF Universal Ltd. changed to M/s DLF Limited vide certificate of incorporation issued by Ministry of Corporate Affairs on 27.05.2006.6. This Plot No. C-4/5 conveyed to M/s DLF Residential Partners Limited from M/s DLF Building& Services Pvt Ltd vide conveyance deed no.11682 dated 12.11.2021.7. Plot No. S-17A/4 and S-17A/2 falling under license no.55 of 1992 dated 19.06.1992 was issued in favour of M/s DLF Universal Ltd. The landowner/license contributed this plot into a partnership firm vide Memorandum of Partnership formed on 29.07.1998. The partnership was named “DLF Residential Developers Limited”. This was registered as a company by the ROC certificate dated 31.07.2008.8. This Plot No. S-69 conveyed to M/s DLF Residential Developers Limited from M/s DLF Real Estate Builders Limited vide sale deed no. 11681 dated 12.11.2021.9. This Plot No. V-10/35 conveyed to M/s DLF Residential Developers Limited from M/s DLF Real Estate Builders Limited vide sale deed no. 11680 dated 12.11.2021.Temp ID-RERA-GRG-PROJ-897-2021Project Name- Independent Floors at DLF City Phase IV10. This Plot No. V-33/18 conveyed to M/s DLF Residential Developers Limited from M/s DLF Real Estate Builders Limited vide sale deed no. 11773 dated 12.11.2021.Further, the present plots owning company i.e., M/s DLF Limited and M/s DLF Home Developers Ltd. and M/s DLF Residential Developers Limited have entered into a Development Agreement to develop independent floors vide registered document no. 11327,11328 and 11444 dated08.11.22021, 08.11.2021 and 10.11.2021 with 50% revenue sharing. On scrutiny of the application, some of the major deficiencies and observations were observed which were conveyed to the promoter vide notice no. HARERA/GGM/RPIN/406 dated 08.12.2021.The promoter has submitted the reply dated 16.12.2021 after scrutinizing the reply following deficiencies are as follows: -1. The annexures in the online are not uploaded as well as the correction needs to be done in the online (A-H).2. Corrections in Detailed Project Information needs to be done. The promoter is directed to correct Form REP-I (Part A-H) and detailed project information and submit the same within a week. Meanwhile, their project will be registered as all major deficiencies have been attended by the promoter and only corrections are to be incorporated in the DPI and online application A to H is to be filled up by the promoter. The Authority has decided to register the project under Section 5 of the Real Estate (Regulation and Development) Act, 2016. |
