The promoter has submitted the reply, which was scrutinized,
and it was found that final approval of service estimates and plans are pending
which was applied on 06.09.2021 and forwarded from Chief Engineer-I,
HSVP, Panchkula to DTCP, Haryana. Vide letter dated 28.12.2021, DTCP,
Chandigarh forwarded letter to the promoter for the submission of additional BG
and vide application 10.03.2022, the promoter has submitted the BG in the
competent authority. The promoter is directed to do the needful corrections in
REP-I (A-H) and DPI and submit the corrected copy within a week.
The authority decides to grant the registration
subject to the submission of bank guarantee/cheque of Rs. 10 lakhs on account
of approved service plans and estimates. The same shall be forfeited in case of
failure to submit the approved service plans and estimates in the authority
within 2 months from the date of grant of registration. |

Ms. Priyanka Aggarwal (AR), Sh. Sanjiv Deogan (Senior
Manager), Sh. Verender Verma (Senior Manager) and Sh. Sandeep Pandey (Manager,
Finance) are present on behalf of the promoter. The promoter has submitted the
consent of 160 allottees today out of total 240 allottees in tower A and C,
which makes consent of more than 2/3rd allottees required for making changes in
the existing lay out plan. The Tower B for which registration is being sought
has no sold units/allottees and hence consent of number of flats under proposed
tower B need not be included in the total number of flats/units. The DTCP has
already accorded approval to the revised building plan for tower B along with
additional FSI allowed under GRIHA and the service plan and estimates are in
advance stage of approval as the additional BG of 1.62 crore already demanded by
DTCP prior to their approval is being provided and an acknowledgement to this
effect will also be submitted in the Authority shortly. The minor corrections
in DPI and form A to H are also being made and corrected/rectified copies will
also be submitted within one week. The licenses of the above colony are valid
upto 30.01.2025 while the promoter has proposed date of completion as
23.08.2026 and an undertaking to keep the licenses/other permission valid
beyond the existing license period of 30.01.2025 and an undertaking to this
effect has also to be submitted.

promoter submitted the reply on 24.01.2022 which was scrutinized and remaining deficiencies
which are still needs to be rectified by the promoter are conveyed to the
promoter. The major deficit documents are corrections in online DPI which are
marked on the DPI and conveyed to the promoter, correction in REP-I (A-H),
approved service estimates and plans and other deficit documents. The promoter
is directed to submit the deficit documents before next date of hearing. Matter

The promoter is
directed to submit the mandatory deficit documents along with corrected online
DPI within a week. The matter regarding allowing additional FAR due to GRIHA is
under consideration of the authority and to be discussed separately as a policy
issue.

Proceedings Dated: 19.10.2021Ms. Jyoti Yadav, Coordinator, Planning Branch briefed about the facts of the project.Ms. Priyanka Aggarwal, Advocate and Ms. Smitakshi Ghosh, Advocate are present on behalf of thepromoter.The AR of the promoter has submitted the reply on 18.10.2021 and is under scrutiny in office.Further the license for the above applied area for registration was granted in 2008 and the same isnow renewed upto 30.01.2025. The revised building plans for the tower requested for registrationhas been approved on 23.08.2021 with a validity upto 23.08.2026. The part occupation certificatein respect of two towers with EWS and club has already been obtained on 22.01.2019 and06.09.2021. Now only one tower B remains to be constructed/developed and has now beenapplied for registration. But this applied area is part of the license granted in the year 2008 andhence will be treated as an ongoing project only and thus the fee and charges are required to bedeposited accordingly. Although the AR submits that no sale in respect to units under this towerhas been made till date.The matter to come up on 25.10.2021. |
