promoter. Ms. Prachi Singh Planning Executive briefed the facts of the
case.
An application regarding registration
of residential floors project namely “DLF Independent Floors at DLF Garden City
Sector 91/92” situated at sector 91 & 92, Gurugram being developed by M/s DLF Residential
Partners Limited was
submitted on 13.05.2021 under section 4 of Real Estate (Regulation and
Development), Act 2016. This application for registration is a part of the residential
plotted colony which having 3 licenses being issued in favour of M/s DLF
Utilities Ltd and others which states as under: -
1. 59 of 2011 dated 28.06.2011 for 101.218
acres for which part completion certificate has been obtained on 02.07.2014.
2. 14 of 2012 dated 27.02.2012 for 62.956
acres. Part completion certificate for an area of 60.14 acres has been granted
on 18.03.2016.
3. 13 of 2019 dated 06.02.2019 for 16.25
acres for which registration is granted by the authority on the same day.
The sale deed was executed by M/s DLF Utilities
Ltd and M/s Sagardutt Builders and Developers Pvt. Ltd. for ownership of 1.047
acres vide sale deed no. 4720 dated 22.03.2021, 30626 dated 01.02.2021,20256
dated 28.12.2006,2715 dated 24.11.2020,4086 dated 19.02.2021 and 3239 dated 18.12.2020.
M/s DLF Utilities Ltd and M/s Sagardutt Builders and Developers Pvt. Ltd.
mutually entered into the development agreement dated 31.05.2021 vide
certificate no. G0282021E4 with M/s DLF Residential Partners Limited Ltd. The
promoter is directed to correct Form REP-I (Part A-H), DPI/online DPI, land
cost needs to be corrected either as per the sale deed or as per circle rate
and copy of approved building plan of 15 plots needs to be provided. The
authorized representative of the promoter has submitted that within a week,
final DPI after incorporating above observations will be submitted. Meanwhile,
their project will be registered as all major deficiencies have been attended
by the promoter and only corrections are to be incorporated in the DPI and also
online DPI is to be filled up by the promoter. The Authority has decided to
register the project under Section 5 of the Real Estate (Regulation and
Development) Act, 2016. |
