An
application regarding registration of group colony project namely “Central
Avenue” situated at sector 33, village Islampur, Gurugram being developed by
M/s Antriksh India Projects Pvt. Ltd was submitted vide central receipt no.
9440/15896 dated 10.02.2021 under section 4 of Real Estate (regulation and
Development), Act 2016.
License
no. 86 of 2019 dated 01.08.2019 valid upto 31.07.2024 issued in favour of Sh.
Kanwar Sain Jain (HUF Karta), Kanwar Sain Jain in collaboration with M/s
Primoris Relators LLP for an area admeasuring 2.123 acres. M/s Antriksh India
Projects Pvt. Ltd has obtained beneficiary interest permission on 23.04.2021
for the licensed area.
After
the scrutiny of the application was done by the authority and deficiencies were
noticed, which were conveyed to the promoter vide letter no.
HARERA/GGM/RPIN/294 dated 18.02.2021 with directions to remove the deficiencies
latest by 25.02.2021 failing which their application may be rejected following
the due procedure as provided under section-5 of the Real Estate Regulation and
development) Act 20l6 and Rule-5 of the Haryana Real Estate (Regulation and
Development) Rules, 20l7. Also, an opportunity of online hearing was offered on
01.03.2021 at 03:00 pm in the office of HARERA, Gurugram. In reference to the
notice dated 18.02.2021, the promoter had submitted the reply on 26.02.2021,
04.03.2021 and 17.03.2021 which was scrutinized and accordingly, on hearing
dated 01.03.2021 and 22.03.2021, the promoter requested for extension of time
to submit the deficit documents. Matter was fixed for 05.04.2021. On
05.04.2021, deficiencies were already conveyed to the promoter. The authorized
representatives of the promoter had made a statement that within 15 days
necessary approvals will be submitted and deficiencies will be rectified.
Matter adjourned to 19.04.2021. Due to
COVID-19 Pandemic, the matter was adjourned for 23.04.2021. On 23.04.2021, an
e-mail request has been received for adjournment in the matter due to lockdown
in Delhi. Matter got fixed for 17.05.2021. But due to Covid-19 pandemic,
authority meeting could not be held, and the authority has decided to fix the
matter on 06.07.2021. The promoter submitted the reply on 05.07.2021 which was
scrutinized and found that the major deficiencies have been rectified except
service estimates and plans (applied on 25.02.2021), copy of service plans and
estimates as applied has been uploaded. The promoter advised to correct
information in Online REP-I (Part A-H) within two weeks. Approvals for sewage
disposal, storm water drainage from competent authority needs to be submitted
within two weeks as water supply assurance submitted.
The
timeline for completion of project declared by the promoter under section
4(2)(l)(C) has been provided as 01.02.2025 which is beyond the validity of the
license i.e., 31.07.2024 was accepted keeping in view the provision of
rule 5(1) of The Haryana Real Estate (Regulation and Development) Rules,2017.
The
Registration is granted subject to the condition that the promoter shall renew
his said license/permission for the remaining period well in time otherwise
their registration may be cancelled after giving an opportunity of hearing.
Online corrections in the DPI shall be done by the promoter within a week as
per their assurance.
The Authority decided to approve the application for grant of
registration. |
