The Promoter M/s M.V.
Buildcon Pvt. Ltd. who is also a license holder applied for the registration of
real estate project namely “Precore City” located at Sector-07, Sohna, Gurgaon
under section 4 of the Real Estate (Regulations and Development) Act, 2016 vide
central receipt no. 10267/19574 dated 13.05.2021 and RPIN-331. The Temp I.D. of
REP – I (Part A-H) is RERA -GRG-PROJ-684-2020. The project area for
registration is same as that of the licensed area i.e. 8.28125 acres for which
Director, Urban Local Bodies, Haryana has granted the license for the
development of Affordable Residential Plotted Colony Under Deen Dayal Jan Awas
Yojana – 2016 vide license no – DULB/CTP/TP-SOHNA/2020/1996 dated 13.03.2020
and there are a total of 178 plots out of which 94 plots are frozen and 84
plots are unfrozen, moreover 30 plots (15% of salable Area) are mortgaged
against the completion of IDW services in the project area as per the DDJAY
policy. The application for registration was scrutinized and 1st deficiency
notice vide notice no. HARERA/GGM/RPIN/331 dated 29.05.2021 was issued to the promoter
with an opportunity of being heard on 07.06.2021, but due to some technical
issues the matter was adjourned due to technical issues and matter was to come
up on 08.06.2021. On 2nd hearing dated 08.06.2021 the promoter had requested
seeking adjournment due to COVID – 19 Pandemic and closure of Corporate
offices, and authority accepted the request and next date of hearing is fixed
for 01.07.2021, however the matter was adjourned to 02.07.2021 Due to COVID-19
Pandemic, and on 02.07.2021.
Sh. Vijay Kumar, Director of M.V. Buildcon
Pvt. Ltd. was present on behalf of the promoter who informs that certain
compliances have been made and reply to the notice dated 29.05.2021 was
submitted on the day of hearing i.e. 02.07.2021. The office was directed to
examine the same and AR is advised to submit compliance of the remaining
deficiencies already conveyed along with entry of the requisite details in
online DPI before the case is further considered.
The AR requested for 15
days’ time to complete the above and the matter was adjourned to 20.07.2021.
The reply submitted by the
promoter dated 02.07.2021 is examined and deficiencies which are still pending
on behalf of the promoter are as under:-
1. Online corrections in
REP-I (Part A-H) needs to be done.
2. Corrections in detailed
project information needs to be done.
3. Legal capacity of the
promoter applying for registration of the project needs to be clarified.
4. Approvals for sewage
disposal, storm water drainage, water supply from competent authority needs to
be submitted.
5. Copy of electrical load
availability NOC not submitted.
6. Draft conveyance deed not
submitted.
7. Copy of superimposed
demarcation plan on approved layout plan on A1 sheet not submitted.
8. PERT Chart needs to be
submitted.
9. Brochure of the projects
needs to be submitted.
10. Collaboration agreement
submitted by the promoter needs to be registered.
11. Bank undertaking needs
to be provided.
12. Cost of infrastructure
development charges needs to be Corrected.
13. Value of estimated sale
proceeds needs to be provided in the DPI.
14. CA Certificate for the
equity infused by the promoter needs to be provided.
15. Quarterly schedule of
estimated expenditure needs to be corrected.
16. Quarterly schedule of
sources of funds needs to be corrected.
17. Net cash flow statement
needs to be corrected.
18. Unique document
identification no. for non-default certificate issued by chartered accountant
needs to be provided.
19. Copy of project report
needs to be submitted.
20. As per the directions to
the builder/promoter with regard to opening of bank accounts as per provisions
of RERA the promoter shall open three bank accounts i.e. Master account,
separate RERA compliant account, free account in the same bank branch, however
as per part H of the DPI same account numbers has been provided by the
promoter. Hence all the three accounts needs to be provided.
21. KYC of the project
consultant i.e engineer, architect, chartered accountant needs to be provided.
Reply has been submitted. Most of the deficiencies
have been completed. The Authority decided to grant the registration subject to
