Timely Possession and Delay Compensation
(Clauses 5, 7.1, 7.6, 9.1, 9.2)
The Promoter is required to deliver possession of the Plot/Unit by 30.09.2027. In case of delay (excluding force majeure), the Allottee is entitled to either withdraw and claim a full refund with interest, or receive monthly interest for the delayed period until possession is offered. These remedies align with Sections 18(1) and 19(4) of the RERA Act.
Defect Liability for 5 Years
(Clause 12)
The Promoter is liable to rectify any structural defects or deficiencies in workmanship or services reported within 5 years from the date of possession, within 90 days, failing which the Allottee shall be entitled to compensation as per the Act. This is in line with Section 14(3) of the RERA Act.
Payment Terms and Interest for Delay
(Clauses 1.4, 1.10, 2, 9.3)
Payments must be made as per the Payment Plan (Schedule C). Delay in payment by the Allottee shall attract interest at SBI MCLR + 2%, as per Rule 15 of the Haryana RERA Rules, 2017. Promoter may cancel the allotment for continued default beyond 90 days after notice, subject to forfeiture of booking amount and applicable interest.
No Alteration Without Consent
(Clause 1.6, 6, 17)
The Promoter cannot change the sanctioned plans, layout, or specifications without the prior written consent of the Allottee, except for minor changes permitted under applicable laws. No additional construction can be made unless authorized by competent authorities, in accordance with Section 14 of the RERA Act.
Execution of Conveyance Deed
(Clause 10)
The Promoter must execute the Conveyance Deed in favour of the Allottee within three to six months of offering possession, provided the Allottee has paid all dues including stamp duty and registration charges. This is in compliance with Section 17 of the RERA Act and Rule 2(1)(f) of Haryana Rules regarding handover of common areas.
